This session examines a recurrent and practical problem in contract administration where a party may surrender contractual rights by possibly inadvertent words or conduct. This involves an analysis of the latest case law dealing with the concepts of waiver, election and estoppel which are the governing legal categories which determine whether particular conduct results in a loss of rights.
